How is the end of usufruct taxed in Spain?
 

Several of our clients buy their Spanish property together with the children.

One option is to buy where the bare ownership is in the children's name and the usufruct in the parents' name.

Other clients have inherited the usufruct on a property in Spain.

Here we describe how the end of usufruct is taxed in Spain.

 

What is bare ownership and what is usufruct?

With usufruct, you have the right to use and rent a property for life as the owner.

You are responsible for day-to-day charges such as taxes and maintenance costs.

The bare owner cannot use the property but gains full ownership when the usufruct expires or

the usufructuary thus dies.

 

The tax at the end of usufruct in Spain depends on

How the usufructuary acquired his rights.

The usufructuary bought the usufruct.

In succession planning, a split purchase is regularly considered.

That is, the parents buy the usufruct and the children buy the bare ownership.

When the parents die, the children obtain full ownership.

In this case, the children will pay registration duties (ITP) on the initial share of usufruct in the new value of full ownership.

These registration fees depend on the autonomous region.

 

On the Costa Blanca, the rate is 10%.

 

On the Costa Del Sol, there is a progressive rate of 8 to 10%.

 

At the time of extinction of usufruct, the prevailing rates apply.

 

An example: You bought a €100,000 property in Spain on the Costa Blanca 15 years ago.

 

The usufruct was valued at 35% (€35,000) and the bare ownership at 65% (€65,000).

 

On death, the usufruct extinguishes.

 

If at death the property is valued at €200,000

the bare owners have to pay 10% on €70,000 (€7,000).
